The tax courtroom denied San Miguel refund of P3.8M

The Court of Tax Appeals (CTA) denied San Miguel Corp.’s appeal. (SMC) pending a review of the court’s decision to reject the company’s request for reimbursement of pesetas 3.8 million excise taxes paid in 2015 San Mig Light in Kegs Product.

In a decision posted on the CTA website on February 4, SMC’s “lack of merit” complaint was dismissed.

SMC alleged that the court should have taken legal notice of the required affidavits regarding the net sales price of its product. Such affidavits form the basis for calculating the excise tax on the product.

SMC said it had already submitted the affidavits to the Bureau of Internal Revenue (BIR).
